The California judge who sentenced a former Stanford University swimmer to six months in jail for raping an unconscious woman is likely to survive the recent efforts to remove him from the bench, experts tell TheWrap. “It’s very, very unlikely,” criminal defense attorney Mark McBride said of the possibility Superior Court Judge Aaron Persky might be ousted. “People have the right to recall judges all they want but unless you get the legal community behind it, it won’t happen.” McBride, who’s tried many sexual assault cases, said Persky was allowed to use his discretion in handing down a sentence on 20-year-old.

Since July, the nation has been transfixed on the heartbreaking disappearance of two Florida teenagers who vanished during a boating excursion. Perry Cohen and Austin Stephanos, both 14, set out for a day of fishing from Jupiter Inlet just hours before a violent storm hit. Though many maintain the most likely scenario is that the storm capsized the boys' boat, some factors point to the possibility of something far more nefarious. "I think there's a 60 percent chance of foul play," Beverly Hills-based criminal defense attorney Mark McBride tells People. McBride bases his suspicions primarily on an as-yet-unexplained discovery on the boy's 19-foot Seacraft boat,...

Donald Trump’s special counsel Michael Cohen has apologized for telling a Daily Beast reporter that legally “you cannot rape your spouse.” Still, several high-profile Hollywood lawyers say Cohen is dead wrong on the law — not to mention being seriously undiplomatic. “Cohen needs to be fired yesterday,” criminal defense attorney Mark McBride told TheWrap Tuesday. “And you can quote me on that.” Cohen, the executive vice president of the Trump Organization, was trying to shoot down a decades-old report that Trump’s ex-wife, Ivana Trump, once accused the Republican presidential front-runner of rape. Ivana Trump has since called the Daily Beast’s story.

On the ground in Moore, Okla., this morning, CNN's Chris Cuomo interviewed Rep. Mark McBride about Monday's devastating tornado and the disaster relief that has begun. Cuomo repeatedly urged the "congressman" on whether his colleagues will cut through politics and bump the relief effort up on their Washington, D.C., priority list. Only one problem: McBride is not a congressman and he has nothing to do with Washington. He's a state representative in Oklahoma.

In light of Chris Brown and Rihanna's sexy reunion—at least, musically, for now—what would happen if they got back together, and he fell back into his punch-happy ways? Chris Brown, 22, doesn't need to physically assault Rihanna, 23, for her to slap him silly -- with a restraining order, says Beverly Hills attorney Mark McBride. "Given Chris Brown's history...even without his history, [Rihanna] could obtain a restraining order by showing that he, for example, constantly causes her to be in fear, has made threatening statements to her, calls her constantly such that it has become annoying, etc.," states McBride. He adds: "She has all the power in the situation, Chris will have to be on his best behavior at all times around her." Do you think this bad boy has learned from his mistakes, Hl-ers? HollywoodLife.com spoke to a legal expert who told us Exclusively that Vanessa Bryant could walk away with a ton of his money in this high-profile split! Kobe Bryant and his wife Vanessa Bryant are headed for divorce, and their 10 and a half year marriage didn't have a prenup. That lack of foresight will almost certainly cost Kobe much of the fortune he amassed in the NBA! Kobe, 33, will have to pay Vanessa, 29, plenty in court, Beverly Hills attorney Mark McBride tells HollywoodLife.com Exclusively. "The marriage is older than ten years," he said. "The rule of thumb is that if you have a marriage that is less than ten years, alimony is about half the length of the marriage. Because the marriage here that is a little bit longer then ten years, she could try to get alimony for quite a longer time, something that would be over five years.
