The episode begins with the killer attaching an electrical wire to the handrail on the pool steps. The victim then dives into the pool and swims for a bit and climbs out without using the steps and is electrocuted when he leans back against the handrail.
BUT, the steel handrail extends into the pool, in contact with the water, thus the entire pool water was electrified. This would've resulted in the man being electrocuted the moment he dived into the water.

The police would have never believed the first victim had died the way he was supposed to have died (of electrocution from touching the TV set with his wet hands). Even a cursory examination would have shown that there were no burn marks on his fingers where he would have touched the TV set. The TV set also would have shown no signs of the electrical short. There also would have been telltale marks on his back from where he had really leaned up against the electrified metal post.
