The case had already been settled under existing law and was being appealed to the Supreme Court. Any change to that law after the case was decided could not be considered on appeal as the decision would not have been rendered if the new law had been in effect. A reversal on appeal based on consideration of the newly changed law would make that new law an ex post facto law, which is not allowed under the US Constitution.
