In the state of New York the crime of murder in the second degree is a class A-I felony, it carries a mandatory minimum sentence of life in prison with the possibility of parole after 15 years. A person who is convicted of murder in the second degree (whether by a jury or a plea bargain) cannot be given a sentence of 12 years in prison, the judge would be legally obligated to sentence them to at least 15 years.
